The Commerce Act contains provisions that aim to discourage anti-competitive business practices such as substantially lessening competition in a market.  While many smaller businesses may not consider that they would be in a position to breach the Act, a business could find itself involved in arrangements such as franchises, joint ventures or joint buying groups that could (inadvertently) substantially lessen competition in their market.

If you have any concerns that your business’ arrangements with other traders could breach the Act then we recommend that you discuss the situation with one of the solicitors at our Howick or Remuera offices.
