Section 15 Property (Relationships) Act 1976

Under the Property (Relationships) Act 1976 there is a presumption of equal sharing of relationship assets when the relationship ends.  However there are exceptions to this presumption under the Act, including under section 15 (which can apply when the income and living standards of one spouse or partner are likely to be significantly higher than the other spouse or partner because of the effects of the division of functions within the marriage, civil union, or de facto relationship while the parties were living together).  Recent cases on section 15 of the Act have shown that significant deviation from a 50/50 sharing of relationship property may arise in certain circumstances.
